India Begins Operationalizing Data Protection Board, Marking a New Phase in Digital Governance

India has initiated the formal process of setting up the Data Protection Board, a critical institution under the country’s evolving digital governance framework. According to senior government officials, the move signals a decisive step toward enforcing the Digital Personal Data Protection Act and strengthening safeguards around personal information. The board will play a central role in adjudicating data breaches, ensuring compliance, and balancing innovation with privacy rights. As India’s digital economy expands rapidly, the establishment of this regulatory body is expected to enhance trust, improve accountability among data fiduciaries, and align the country with global data protection standards.

Foundation of a New Data Governance Regime

The government has begun groundwork to operationalize the Data Protection Board, an institution designed to oversee compliance with India’s data privacy law. The initiative reflects New Delhi’s intent to move from legislative intent to regulatory execution, ensuring that the rights outlined in the law are enforceable in practice.

Penalties under the law can be substantial, running into several hundred crore rupees, depending on the severity of the breach. This enforcement mechanism is expected to compel companies to invest more rigorously in cybersecurity and data governance systems.
