FRAI Calls for Review of Tobacco Excise Duty to Address Market Distortions

The Federation of Retailers Association of India (FRAI) has urged the government to reassess the current excise duty framework on tobacco products, citing growing concerns over market imbalance, revenue leakage, and the expansion of illicit trade. According to the association, steep and uneven taxation has strained legal supply chains while inadvertently encouraging unregulated alternatives. FRAI argues that a calibrated duty structure could protect government revenues, support legitimate businesses, and ensure better regulatory oversight. The appeal comes amid broader policy discussions on balancing public health objectives with fiscal sustainability and economic stability.

Retailers Flag Structural Issues in Excise Policy

FRAI has raised concerns that the existing excise duty regime on tobacco products has created unintended consequences across the retail ecosystem. High tax incidence, the association notes, has widened the price gap between legally manufactured products and illicit alternatives, making compliance increasingly difficult for authorized retailers. According to industry estimates, this disparity has eroded volumes in the regulated market while weakening enforcement effectiveness.

Impact on Government Revenue and Compliance

The association cautioned that excessive taxation may be counterproductive from a revenue perspective. As legal sales decline, tax collections risk stagnation or erosion, even as consumption shifts to untaxed or under-taxed channels. FRAI emphasized that a rationalized duty structure could improve compliance, stabilize volumes, and ultimately enhance predictable revenue flows for the exchequer.

Illicit Trade Emerges as Key Concern

One of the central arguments presented by FRAI is the rapid growth of illicit tobacco trade, including smuggled and counterfeit products. These goods not only bypass tax mechanisms but also undermine consumer safety due to the absence of quality controls. Retailers argue that unchecked illicit trade distorts competition and weakens the formal retail sector, particularly small businesses that rely on lawful distribution networks.

Balancing Public Health and Economic Realities

While acknowledging the importance of public health objectives, FRAI stressed that taxation policy must be balanced and evidence-based. The association suggested that extreme tax measures may not significantly reduce consumption but instead shift demand to unregulated markets. A more nuanced approach, it argued, would allow the government to pursue health goals while maintaining economic order and regulatory control.

Outlook: Call for Data-Driven Policy Review

FRAI has called on policymakers to undertake a comprehensive review of tobacco excise duty, incorporating data on consumption trends, revenue outcomes, and enforcement challenges. Analysts believe the issue is likely to gain traction as the government evaluates broader tax reforms and revenue strategies. Any recalibration, they say, would need to carefully align fiscal priorities, public health considerations, and the sustainability of the legal retail ecosystem.
