Justice Yashwant Varma Defies Resignation Pressure, Cites Breach of Natural Justice

Justice Yashwant Varma has formally refused to step down or seek voluntary retirement following allegations of misconduct tied to a cash recovery from his residence earlier this year. In a forthright letter addressed to then Chief Justice of India Sanjiv Khanna, dated May 6, Justice Varma argued that such a decision, urged within 48 hours of receiving the investigative panel's findings, would signify a surrender to a flawed and unjust process. The judge raised concerns over procedural fairness, notably the denial of a personal hearing, and questioned the integrity of the inquiry conducted by a three-judge panel.

Judge Pushes Back Against Resignation Demand

Justice Yashwant Varma, under scrutiny following the discovery of undisclosed cash at his Delhi home, has chosen to challenge—not comply with—suggestions to vacate his judicial position. In a strongly articulated letter addressed to the then Chief Justice of India (CJI), Sanjiv Khanna, Justice Varma highlighted what he deemed serious violations of due process.

The letter, written on May 6, came just two days after he received the CJI’s communication advising resignation or voluntary retirement. Justice Varma stressed that such a demand, framed within an arbitrary 48-hour timeframe, not only disregarded procedural propriety but also threatened to undermine the dignity of judicial service.

“Fundamentally Unjust and Requiring Review”

Justice Varma’s response described the internal inquiry process as “fundamentally unjust.” The crux of his objection centered on the absence of a personal hearing—an opportunity he insists should have been offered following the submission of the in-house panel's report.

He criticized the inquiry for failing to inform him of any preliminary findings, thus denying him the ability to meaningfully address allegations before conclusions were drawn. “At no point during the inquiry was I informed of the Committee’s preliminary or tentative views,” his letter states, citing this as a critical deviation from established judicial norms.

Tenure and Reputation in the Balance

With over 11 years of service in the Indian judiciary, Justice Varma’s assertion reflects not only his resistance to what he perceives as institutional coercion but also a broader concern for preserving the integrity of judicial procedures. “A decision such as the one your letter advises me to take necessarily entails due deliberation and thought,” he wrote, emphasizing that such weighty matters cannot and should not be subjected to a two-day ultimatum.

This position has intensified attention on the internal workings of the higher judiciary, particularly around transparency, fairness, and accountability mechanisms in cases involving senior judges.
